1. Who you are contracting with

Social Work Confidential (the "Service") is operated by Erica Jew, a sole proprietor doing business as Social Work Confidential ("we", "us", "our"). By creating an account, purchasing access, or otherwise using the Service, you enter into a binding agreement with Erica Jew.

2. Acceptance of these terms

By accessing or continuing to use the Service you agree to these Terms & Conditions. If you do not agree, do not use the Service. You represent that you are of legal age in your jurisdiction (or have the authority to bind the organization on whose behalf you are using the Service) and that the information you provide is accurate and kept up to date.

3. The Service

Social Work Confidential is an exam preparation game designed to help candidates study for the ASWB LMSW licensing exam. It is a study aid only. It is not the ASWB exam, is not affiliated with or endorsed by the ASWB, and does not guarantee any exam outcome.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Notify us promptly if you suspect unauthorized use.

5. Acceptable use

You agree not to:

use the Service for any unlawful purpose or in violation of any applicable law;
commit fraud, send spam, or impersonate any person or entity;
infringe the intellectual property rights of Erica Jew or any third party;
interfere with the security or integrity of the Service, including by introducing malware, probing or scanning systems, scraping content, or circumventing technical limits;
resell, sublicense, or redistribute the Service or its content.

6. Intellectual property

The Service, including all software, question banks, text, graphics, branding, and design, is owned by Erica Jew and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal exam preparation while your account is in good standing. No other rights are granted.

7. Payments, billing, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing frequency, taxes, currency, cancellations, and refund mechanics are governed by Paddle's Buyer Terms. Refund eligibility is described in our Refund Policy.

8. Service availability

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. Features may change or be discontinued.

9. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these terms, non-payment, suspected fraud or security risk, or repeated or serious violations of our acceptable use rules. You may stop using the Service at any time.

10. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Erica Jew disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. The Service is a study aid and is not a substitute for professional advice, formal education, or the actual ASWB LMSW exam.

11. Limitation of liability

To the fullest extent permitted by law, Erica Jew's aggregate liability arising out of or relating to the Service will not exceed the amounts you paid for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Erica Jew from any claims, damages, or expenses arising from your misuse of the Service or violation of these terms.

13. Governing law

These terms are governed by the laws of the United States and the state in which Erica Jew resides, without regard to conflict-of-laws principles.

14. Changes to these terms

We may update these terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
